Article 1. Definitions

  • These General Terms and Conditions (referred to as “Terms”) are applicable to all services provided by Yakut Host (“Yakut Host” or “we”) to the Client (“Client”).

    • Client: The individual or entity purchasing services offered by Yakut Host.
    • Consumer: An individual acting outside business, commercial, or professional activities.
    • Professional customer: An individual or entity engaged in entrepreneurial, commercial, or professional activities, or an intermediary thereof.
    • Consumer Protection Law: Refers to applicable consumer protection laws relevant to the Client’s jurisdiction.
    • Privacy Law: Refers to applicable privacy protection laws relevant to the Client’s jurisdiction, including but not limited to the General Data Protection Regulation (GDPR) for clients within the European Union.
    • GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
    • Parties: Yakut Host and the Client.
    • Services: Services offered by Yakut Host to the Client, as described on the website and governed by these Terms.
    • Shared service: Hosting where a single server hosts multiple websites owned by different individuals.
    • Dedicated service: Hosting where a single server is dedicated to hosting one website or multiple websites owned by a single individual.
    • Website: www.yakuthost.net
    • User: Any person, natural or legal, utilizing the Services, including those using the Services on behalf of the Client (e.g., employees or collaborators of the Client).

Article 2. The service we provide:

  • Yakut Host agrees to host your website on one or more servers (referred to as “Service”) for the duration of the paid period, provided you comply with these Terms and any other agreements related to the Service, in consideration of the prepaid fees (“Fees”).
  • We provide the Service according to the specifications described in the hosting plans (“Plans”) selected by the Client during the registration process.
  • We aim to maintain stable pricing for our Plans, but unforeseen circumstances, such as increased rates from our providers, may necessitate price adjustments. In such cases, we will notify the Client 30 days prior to the renewal date of any price updates. The Client will have until the expiration date to notify us of their desire to terminate the Service.
  • We reserve the right to immediately terminate the Service if the Client violates these Terms or any related policies. If mutual trust and satisfaction are not maintained, we will notify the Client at least 15 days before the renewal date, indicating their inability to renew or purchase a new Service. In this case, the Client will have the opportunity to back up their website data for migration. An invoice for renewal will not be sent, and if sent, it will be canceled.
  • For clarity, “Services” on this page refer to various services offered by Yakut Host to the Client and, if applicable, services provided related to the affiliate program.

Article 3. Permission to host your content

  • For Yakut Host to host the Client’s website, the Client needs to upload its content and files to our servers. Uploading content creates one or more copies of the Client’s content on our systems.
  • By purchasing hosting services from Yakut Host, the Client acknowledges the creation of these copies and grants Yakut Host a license to maintain them on our servers and make them available to internet users.
  • The Client is solely responsible for providing all content and data constituting their website.

Article 4. Personal Information

  • When ordering our Services, your personal information, including credit card information, is transmitted through a secure connection using Secure Socket Layer (SSL) technology.
  • We prioritize Client privacy and do not sell personal information to third parties (except in cases of acquisition or takeover of Yakut Host).
  • The Client agrees to be contacted by a Yakut Host representative at the telephone number provided during registration or by email for important information regarding Yakut Host products or services.

Article 5. Activation of the Service

  • All orders placed with Yakut Host are subject to automatic verification by an anti-fraud system.

    If an order is flagged as potentially fraudulent, we will request the customer to provide a copy of an identity document to verify the accuracy of the information provided during the order process.

    If the provided information is verified as accurate, we will delete the identity document from our systems and proceed to manually activate the order. If the information does not match, we will delete all account details, including the copy of the ID.

    We reserve the right to not activate the service in the following cases:

    • The customer has requested a warranty refund in the past.
    • The information provided is not real, or we suspect it is not.
    • The customer has defaulted on payments in the past.

    In some instances, a dedicated server may appear available at the time of ordering but may not be available in the datacenter during activation. In such cases, we will credit the amount paid to the customer’s account, allowing the customer to choose another available server.

    Similarly, a domain may be unavailable or classified as premium at the time of registration. In these cases, we can either refund the amount to the user’s credit or the payment method used, or adjust the invoice price according to the customer’s preference.

Article 6. Backup Service

  • Yakut Host provides an automatic backup service to our customers. We maintain the last 30 days of backups for each account (or sub-account in the case of reseller hosting plans).
  • However, we are not responsible for problems related to corrupt or incomplete backups. Therefore, we strongly recommend that all customers maintain their own local backups.
  • Shared Services customers have access to a control panel that allows them to independently restore a backup. If the customer prefers us to handle the restore operation, it will incur a cost as listed in our price list. Backups for shared services are provided via JetBackup.
  • Dedicated service customers can opt for an additional service called “Disaster Recovery,” which provides access to a control panel for restoring their backups. The number of backups maintained is decided together with the customer based on the space purchased for “Disaster Recovery.” We can perform the restore from backup at a cost listed in our price list. If this service is not purchased, we still perform backups; however, there is no access to the restore control panel, and the operation incurs a cost listed in our price list. If a “Disaster Recovery” solution is not purchased, we cannot guarantee 30 days of backup for dedicated services; in such cases, the backup service will be provided on a “best effort” basis. Backups for dedicated services are provided through R1Soft (JetBackup is available for an additional fee).
  • While we endeavor to maintain the integrity of backups, we cannot guarantee it. The customer is solely responsible for the integrity of their data.

Article 7. Satisfaction Guarantee

  • Yakut Host offers a 30-day Money Back Guarantee for shared hosting services only. This guarantee does not apply to dedicated servers, virtual private servers (VPS), or domain registrations.
  • Cancellation operates as follows: if you delete your account within 30 days, we will refund the amount you paid, excluding any non-refundable fees listed below.
  • Non-refundable costs include:
  • Domain registration or transfer
  • Dedicated IP
  • SSL certificates and their installation
  • Installation or activation of scripts or services
  • Sitelock
  • SSH access
  • VPS, cloud, or other dedicated solutions
  • Software licenses
  • Website migration costs
  • The registration fee for each domain is equal to its activation cost.
  • To obtain a refund, the customer must open a ticket in the administration section within 30 days from the date of purchase. The date of the refund request, not the cancellation date, will be taken into account. If the customer cancels from the client area without opening a ticket, the request will not be reviewed manually, and we will assume the customer does not want a refund.
  • The money-back guarantee is void if our terms are violated, which can be viewed on our website, or if the terms of service are not respected.
  • The 30-day period begins from the date of the first purchase. This guarantee does not apply to renewed services.
  • This guarantee is only valid for the first purchase. A customer who already has a service with us cannot claim the guarantee for subsequent purchases, even if made through a different account in the client area.
  • Under no circumstances can a refund be issued for a renewed service.

Article 8. Right of Withdrawal for Consumers

  • Consumer customers, by law, have a 14-day period to exercise the right of withdrawal in distance contracts or contracts concluded away from business premises.
  • To exercise the right of withdrawal, the consumer must contact the supplier within 14 days of signing the contract, expressing their desire to withdraw.
  • The supplier has an additional 14 days from the notice of withdrawal to refund the amount due to the consumer.
  • However, the supplier is entitled to retain the amount corresponding to services already performed at the time of withdrawal, along with the amounts indicated in the Satisfaction Guarantee section. The right of withdrawal is effective only for the first activation of the contract and not for each subsequent single renewal.
  • With regard to services, the right of withdrawal cannot be exercised by the customer/consumer after the service has been fully provided. The customer/consumer explicitly agrees to waive the right of withdrawal following the full performance of the service by the supplier. For example, the start of the procedure for registering a domain name or the activation of email accounts constitutes “full provision of the service” as per applicable laws.

Article 9. Guaranteed Friendly Support

At Yakut Host, we believe in providing support that is not only efficient but also friendly and respectful. Our dedicated team is available 24/7, ready to assist you with any inquiries or issues you may have regarding the management of your website and server. We are committed to ensuring that our customers can manage their websites and servers smoothly, and we do not hesitate to offer any assistance necessary to achieve this goal.

Article 10. Ticket Abuse

Yakut Host prioritizes respectful communication. We believe in treating our customers with the utmost respect and kindness. We reserve the right to suspend accounts only in extreme cases where a client’s behavior is consistently disrespectful or abusive towards our staff. Our aim is to maintain a supportive and positive environment for all our customers.

Article 11. Transfer Promotion

At Yakut Host, we prioritize swift and efficient website transfers. For WordPress websites, transfers are completed within 48 hours of your request, free of charge. For custom-coded websites, our transfer service is completed within 7 days of your order date. Our team ensures meticulous attention to detail during the transfer process, guaranteeing a seamless transition to our services. Transfer costs for WordPress websites are waived as part of this promotion. Any additional details or requirements regarding the transfer process will be communicated clearly during the arrangement process.

Article 12: Payments

At Yakut Host, we aim to maintain transparent billing practices to ensure that customers are aware of all charges and can manage their payments with ease.

12.1 Account Renewals and Billing Cycles

  • Account Renewals: Renewals are automated, and invoices are issued in advance to allow time for customers to complete payments before the due date.
  • Domain Renewals: We proactively send renewal reminders for domains to ensure continued service without interruption. It is the customer’s responsibility to act upon these reminders.

12.2 Payment Methods

We accept a variety of payment methods, including:

  • Credit/Debit Cards (Visa, MasterCard, etc.)
  • Bank Transfers
  • Cryptocurrencies: We accept payments in cryptocurrencies such as Bitcoin, Ethereum, and other supported digital currencies. For cryptocurrency payments, the transaction must be confirmed on the blockchain before services are activated.

12.3 Cryptocurrency Payments

  • Exchange Rate Fluctuations: Due to the volatility of cryptocurrencies, the price of services in digital currencies is locked in only during the payment window. If payment is delayed, customers may need to refresh their invoice to account for updated cryptocurrency prices.
  • Transaction Confirmation: Services will be activated upon successful confirmation of the payment on the blockchain. The confirmation time varies depending on network congestion and other factors.
  • Refunds: Refunds for payments made in cryptocurrencies will be processed at the current exchange rate at the time of the refund, not the original payment rate, subject to our refund policies.

12.4 Domain Management Policy

  • Domain Expiration: Domains are taken offline by the registrar the day after expiration. Failure to make payment by the due date will result in the domain being taken offline.
  • Grace and Redemption Periods: Domains enter a grace period followed by a redemption period before complete expiration. Recovery of a domain during the redemption period incurs additional fees.
  • Customer Responsibility: Customers are responsible for ensuring timely renewal. If an email confirmation of renewal is not received within 24 hours, customers should contact support immediately. Failure to check may lead to domain expiration.

12.5 Shared Services

  • Suspension for Non-Payment: If full payment is not received within 5 days of the hosting service billing date, your account will be suspended. During suspension, your data, website, and other associated services will be inaccessible.
  • Reactivation Upon Payment: Payment within 15 days will result in account reactivation, granting access to all data and services. A late fee may apply, which is non-negotiable.
  • File Deletion for Prolonged Non-Payment: If payment is not received within 20 days, all files on the server will be permanently deleted, and we are not responsible for any data loss.

12.6 Dedicated Services

  • Service Suspension: Dedicated services like VPS, cloud plans, and dedicated servers will be suspended 24 hours after the billing due date. Reactivation fees will apply as per the price list.
  • Service Termination: If payment is not made within 10 days of suspension, the service will be terminated, resulting in loss of data. We do not guarantee recovery of deleted data once the service is terminated.

12.7 Certified Email

  • Suspension and Recovery: Certified email services may also be suspended for non-payment. Expired emails can be recovered at an additional cost.

Article 13. Transfer of a Domain

If you transfer a domain that was purchased together with a hosting service to another registrar, the hosting service will be automatically deactivated.

Article 14. Free Domain

At Yakut Host, some of our plans offer the added benefit of a complimentary domain registration, transfer, or renewal. However, it’s important to note that this promotion is applicable only if the domain is acquired simultaneously with the plan. Once the domain is obtained, it cannot be altered, nor can the free domain offer be availed of in the future.

If you already possess a domain or hosting plan with us, participation in this promotion is restricted unless you opt to purchase a new hosting plan accompanied by a new domain.

Please be aware that the availability of free domains is subject to change periodically. While we may currently offer a .com domain with our services, the domain extension provided for free may vary in subsequent cycles. We cannot guarantee which domain extension will be included in the free domain promotion at any given time. Our objective is to maintain transparency and fairness by periodically offering different domain extensions as part of our free domain promotions.

In certain circumstances, our system may automatically detach the domain from your hosting plan. This can occur if you manually renew the domain from the client area, if there is a delay leading to the suspension of your plan, if you transition from annual to monthly payment cycles, or if you choose to disable automatic domain renewal, among other scenarios.

Article 15. Copyright Infringements

At Yakut Host, we maintain a zero-tolerance policy towards copyright infringement.

In appropriate circumstances and at our sole discretion, we reserve the right to disable and/or terminate the accounts of copyright infringers. If you believe that your work has been unlawfully copied or your intellectual property rights have been violated, please provide us with the following information:

  1. An electronic or physical signature of the individual authorized to act on behalf of the copyright owner or other intellectual property rights holder.

  2. A description of the infringed work.

  3. Details regarding the location of the infringing material on our website.

  4. Your contact information, including your address, phone number, and email address.

  5. A statement affirming that the unauthorized use of the material constitutes a violation of copyright or law.

  6. A statement verifying the accuracy of the provided information and confirming that you are the copyright owner or authorized representative.

By providing this information, you enable us to take appropriate action against copyright infringements, ensuring the protection of intellectual property rights within our services.

Article 16: Suspension and Interruption of Service

Yakut Host reserves the right to suspend or interrupt services at any time and without prior notice under the following circumstances:

  1. Terms Violation: If, in the judgment of Yakut Host, the customer breaches the terms of service, acceptable use policy, or service level agreement.

  2. Network or Equipment Failure: In the event of a failure in the network or equipment essential for service provision.

  3. Unscheduled Maintenance: Essential and unscheduled maintenance required to maintain the service.

  4. Failures or Malfunctions: Incidents leading to failures or malfunctions affecting the provision of service.

  5. Security or Confidentiality Reasons: If justified by reasons related to security, confidentiality, or the need to protect data privacy in accordance with the UK Data Protection Act 2018 and GDPR.

  6. Threats to Network, Equipment, or People: Threats that could endanger the network, equipment, or individuals, including situations where customer data or systems could be compromised.

If an account is compromised, we will promptly suspend the account and notify the customer via email, providing details of the reason for suspension. Access to the account will only be granted to the customer’s or WebMaster’s IP address to address the issue before restoring the website online.

Cancellation and Refund Policy: Customers may cancel their services at any time by submitting a written request. Any prepaid fees for unused services will be refunded based on our refund policy, provided that no violation of these terms has occurred. In cases of contract termination due to policy violations, no refunds will be provided.

Yakut Host aims to minimize disruptions and will endeavor to resolve such situations swiftly. In cases where the suspension is due to a breach of terms or misuse, restoration of services may be conditional on the customer’s compliance with our terms and policies.

Art. 17.  Limitations  of  Liability of  YAKUT HOST

YAKUT HOST acknowledges and recognizes that the input of information into the space and the subsequent dissemination of the same on the internet network, through YAKUT HOST’s services, are carried out exclusively at the Customer’s own risk. The Customer acknowledges that the internet network is not controlled by YAKUT HOST and that, due to its peculiar structure, neither public nor private entities, including YAKUT HOST, can guarantee and monitor the performance and functionality of the network branches or control the contents of the information transmitted through its network. Therefore, the Customer acknowledges and accepts that no responsibility can be attributed to YAKUT HOST for the transmission or receipt of illegal information of any kind. The Customer agrees to indemnify YAKUT HOST for any liability action that may be initiated by third parties in relation to violations of national or international laws committed by the Customer. The Customer shall bear all costs, damages, and charges, including any legal fees, arising from such liability actions and undertakes to inform YAKUT HOST if such a liability action is initiated against it.

YAKUT HOST does not provide any guarantee to the Customer or third parties that the Service is perfectly suited to particular purposes. No responsibility may be attributed to YAKUT HOST if the provision of the Service, with the precise characteristics required by the Customer, is conditional on the actions of third parties (for example, but not limited to: YAKUT HOST’s suppliers).

The Client, relieving YAKUT HOST of any relevant responsibility, acknowledges and accepts that:

  • The use of services provided in collaboration with other infrastructures (national and international) is limited to the boundaries and rules established by the managers of such services, as well as by the laws in force in the countries hosting such services and by relevant international laws.
  • Technical interruptions of services due to failures and malfunctions of machines and software, whether owned by YAKUT HOST or its suppliers, are always possible.
  • The very nature of Internet services, in which many entities are involved, does not allow YAKUT HOST to provide any guarantee regarding the constant usability of the service and/or the possibility of reaching any web space from all over the world and/or the transmission and reception of information and/or the delivery and reception of mail messages, let alone guarantee the confidentiality and privacy of the same.
  • The actual speed of the Internet connection depends on the degree of network congestion, the quality of the access network, and the Customer’s equipment. Therefore, YAKUT HOST is unable to guarantee the actual achievement of the nominal speed.
  • The use of internet services to other nodes of the internet network, not under the management of YAKUT HOST, will be subject to the limitations and responsibilities established by each service provider and must be carried out in accordance with the laws in force in the countries hosting these nodes and services, with international legislation in this area, and with the regulations of use of the networks and nodes concerned.

YAKUT HOST is committed to ensuring the best functionality of the system but does not assume any responsibility towards its Customers or Third Parties for delays, malfunctions, suspension, and/or interruption in the provision of the Service caused by causes not attributable to it, such as, but not limited to:

  • Unforeseeable circumstances, catastrophic events, and force majeure.
  • Actions of third parties (for example, but not limited to: unauthorized publication by third parties of texts entered by the Customer in any messaging area, public or private).
  • Malfunctioning or non-conformity of the connection devices with which the Customer is equipped or, in any case, of those used by him/her.
  • Tampering with or intervention in the services or equipment carried out by the Client or by Third Parties not authorized by YAKUT HOST.
  • Incorrect use or non-compliant use of the Service by the Customer, to these Terms and Conditions of Use, or otherwise failure of the Customer to comply.
  • Failures and malfunctions of machines and software, whether owned by YAKUT HOST or its suppliers.

In such cases, YAKUT HOST shall not be liable for any loss, damage, or injury suffered by the Customer and/or Third Parties, whether direct or indirect, foreseeable or unforeseeable, including but not limited to economic/financial losses, business, revenues and profits, and/or commercial goodwill. Therefore, the Customer acknowledges and accepts that it shall have no claim against YAKUT HOST for compensation, indemnity, reimbursement, or any other reason.

Art. 18. Managed Dedicated Services

YAKUT HOST’s managed dedicated services encompass VPS, Cloud plans, and dedicated servers with a managed contract, inclusive of support from us.

The root password is not initially provided to the Customer but can be requested via ticket, contingent upon a valid reason. Some customer operations may nullify the “Managed” contract, and support may be billed accordingly, as outlined in the paid services section.

Support is delimited to the following:

Hardware management, monitoring, and replacement.

Network availability.

Free installation of the control panel at the time of purchase.

Optimization of the control panel and operating system upon activation.

Securing the VPS at activation.

Free migration of up to 10 accounts if the control panel matches the activation.

Management encompassing all aspects of the operating system, along with support and troubleshooting related to the operating system and standard control panel components.

cPanel/WHM:

Initial installation.

Initial service optimization.

Version upgrade/downgrade (excluding EDGE build).

Repair.

License.

Troubleshooting automatic updates.

Email services:

Upgrade/reinstallation of exim MTA.

Upgrade/reinstallation of courier-imap POP3 and IMAP service.

Installation/upgrade/reinstallation/uninstallation of SpamAssassin.

Installation/upgrade/reinstallation/uninstallation of ClamAV antivirus.

Troubleshooting and repair of email delivery issues (excluding issues due to third-party services).

Horde/IMP and Squirrelmail webmail troubleshooting.

Web service:

Apache web server recompilation.

PHP upgrade or recompilation with additional modules/options supported directly from cPanel.

Editing PHP configuration.

Installation/upgrading/removal of ionCube.

Installation/updating/deleting of Zend Optimizer.

Installation/upgrade/deletion and Accelerator.

Apache/PHP troubleshooting and repair and possible configuration (excluding custom configurations).

MySQL:

MySQL version upgrade.

Repair of MySQL installation.

MySQL database repair/optimization.

Troubleshooting problems with MySQL startup or connectivity.

Nameserver:

Named repair/reinstallation.

Named configuration and troubleshooting.

FTP service:

Upgrade/reinstallation of proftpd or pure-ftpd FTP server.

Switching between pure-ftpd and proftpd.

FTP service configuration and troubleshooting (excluding custom configuration rules and custom FTP forms).

Art. 19. Paid Services

For additional services and support beyond the scope of standard assistance, customers must engage with us through the support ticket system.

Free support is limited to server-related services or failures and their configurations. We do not offer free support for customizations, third-party script support, or other services. However, we are available to provide a quote based on the nature of the required work.

Article 20: Phishing and Abuse

If any customer misuses our services for phishing, fraudulent activities, or other forms of online abuse, immediate action will be taken. Upon receiving a report or complaint from a third party regarding such misuse, Yakut Host will investigate the matter. If the claim is found to be valid, all services associated with the offending individual will be deactivated.

In accordance with the UK Data Protection Act 2018 and GDPR, if requested by law enforcement or legal authorities, Yakut Host will provide all available information related to the offending individual, including logs and other relevant data, to assist in legal proceedings.

In addition, the following abusive activities will lead to immediate service suspension and possible legal action:

  1. Publishing or hosting illegal content: If a customer violates our policies by publishing illegal, pornographic, or unethical content, their services will be immediately suspended. This applies particularly to content that violates UK law or international standards.

  2. Racially discriminatory or hate speech: If a customer publishes racially discriminatory or hate-inciting content, they will be issued a warning. If the content is not removed within a given time frame, their services will be deactivated in accordance with anti-discrimination laws in the UK and internationally.

  3. Spamming: Sending unsolicited emails (spam) via our services is strictly prohibited. Any customer engaging in spam email campaigns will have their services immediately deactivated to maintain a secure and spam-free environment for all users.

We are committed to ensuring that our platform complies with international privacy rights, UK laws, and anti-discrimination laws. Violations of these standards may result in permanent service suspension and the sharing of customer information with legal authorities, as permitted by applicable law.

Article 21: Jurisdiction and Applicable Law

These terms and conditions are governed by international standards and regulations, taking into account the jurisdictions of the United Kingdom and other applicable countries. Yakut Host aims to ensure compliance with all relevant international laws, including those covering privacy, consumer protection, and anti-discrimination.

For disputes regarding the interpretation, execution, or termination of these General Terms and Conditions of Sale, the following provisions apply:

  • UK-based customers: Any legal disputes will be governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction.

  • Non-UK-based customers: For customers based outside the United Kingdom, the laws of their respective domiciles may apply, depending on international and local consumer protection regulations.

In cases where a conflict arises between local laws and these terms, we will strive to comply with the laws of the customer’s jurisdiction, as long as they align with UK law and international standards.

Yakut Host reserves the right to update these terms at any time. Any changes will be communicated to customers, and continued use of our services implies acceptance of these changes.

Art. 22. Acceptance of Terms and Conditions of Use

This agreement becomes effective at the moment the Customer submits an order or opens an account for any of our services. If a Customer does not agree with these terms, they may cancel their account or contact the administration for assistance with cancellation. By signing up for or continuing to use our services, the Customer agrees to the terms outlined herein.

By utilizing our services, you acknowledge that you have read and agreed to all the terms presented in this document, as well as those found on the relevant pages of our website.
